Kenya Court Halts $2.5B Health Deal with the United States

Kenya’s High Court has temporarily stopped the implementation of the $2.5 billion health cooperation framework signed between Nairobi and Washington. The ruling immediately suspended the section of the agreement involving the transfer of Kenyan health and personal data, following a petition filed by the Consumer Federation of Kenya.

Justice Mwamuye ordered that the state refrain from executing any part of the framework while the case is under consideration. The petitioners argued that once Kenya’s medical and epidemiological data is transferred abroad, the damage becomes irreversible since the country would have no oversight over how such information is used.

The health pact was signed on December 4 by President William Ruto and US Secretary of State Marco Rubio. It is intended to replace fragmented legacy agreements that had long been overseen by USAID before it was dismantled earlier this year. The United States is set to contribute $1.7 billion over five years, with Kenya covering the remaining $850 million. The plan targets HIV/AIDS, tuberculosis and malaria prevention and treatment, with faith‑based facilities expected to play a significant role alongside government‑linked clinics under Kenya’s insurance scheme.

The government has not yet responded to the suspension, and the US has not issued new comments on the ruling. The court case introduces uncertainty into a partnership that had been framed as a cornerstone of Kenya’s next phase of public‑health investment.

Observers note that Kenya’s judiciary continues to assert its independence in major policy decisions, even as the executive seeks deeper global partnerships. What remains clear is that public data and national sovereignty remain highly sensitive issues, especially where long‑term health infrastructure is concerned.

Still, Kenya’s young population and expanding health sector continue to show resilience. Even amid legal and political turbulence, the groundwork for stronger systems, better access and more coordinated care continues to grow.
